DEFINITIONS AND CLASSIFICATIONS

Cookies

As is well known, cookies are usually strings of text that websites (so-called "publishers", or "first parties") visited by the user or different websites or web servers (so-called "third parties") place and store - directly, in the case of publishers, and indirectly, i.e. through them, in the case of "third parties" - within a terminal device available to the user.

The terminals referred to are, for example, a computer, a tablet, a smartphone, or any other device capable of storing information. Already today, and even more so in the future, these include the so-called IoT (Internet of Things) devices, which are designed to connect to the network and to each other to provide services of various kinds, not necessarily limited to mere communication. The software for surfing the Internet and operating these devices, e.g. browsers, can store cookies and then transmit them back to the sites that generated them on the occasion of a subsequent visit by the same user, thus keeping a record of his or her previous interaction with one or more websites. The information encoded in cookies may include personal data, such as an IP address, user name, unique identifier or email address, but may also contain non-personal data, such as language settings or information about the type of device a person is using to browse the site. Cookies can therefore perform important and diverse functions, including tracking sessions, storing information about specific configurations of users accessing the server, facilitating the enjoyment of online content, etc. They can, for instance, be used to keep track of the items in an online shopping cart or the information used to fill in a computer form. If, on the one hand, it is through cookies that it is possible, among other things, to allow web pages to load more quickly, as well as to route information on a network - in line, therefore, with fulfilments strictly related to the very operation of websites, again through cookies it is also possible to convey behavioural advertising and then measure the effectiveness of the advertising message, i.e. to conform the type and modalities of the services rendered to the user's behaviour that was previously observed.

Since it is not possible to distinguish cookies on the basis of their technical characteristics, they can be subdivided as explained below.

The main subdivisions relate to origin, according to which one identifies:

  1. first-party cookies, which are installed directly by the site operator on the user's terminal;
  2. third-party cookies, installed by a different site through the operator of the site the user is visiting;

Since it is not possible to distinguish cookies on the basis of their technical characteristics, they can be subdivided as explained below.

The function pursued by cookies, by which they are distinguished:

  • technical cookies, which are those used for the sole purpose of 'carrying out the transmission of a communication over an electronic communications network, or to the extent strictly necessary for the provider of an information society service explicitly requested by the contracting party or user to provide such service' (cf. Art. 122, para. 1 of Legislative Decree 196/03). No consent is required for such cookies.
  • profiling cookies, which are those used to link specific actions or behavioural patterns recurring in the use of the offered functionalities (pattern) to specific identified or identifiable subjects, in order to group the different profiles within homogeneous clusters of different sizes, so that the owner can, among other things, also modulate the provision of the service in an increasingly customised manner beyond what is strictly necessary to provide the service, as well as send targeted advertising messages, i.e. in line with the preferences expressed by the user while surfing the web. These cookies can only be used with the consent of the person concerned, which is also the legal basis for the processing. The User can never be obliged, without alternative, to give his or her consent to receive such cookies, failing which he or she will be unable to access the site.
  • Analitycs cookies that carry out analysis and statistics on the use of the site and the flow of surfers. In the site in question they are subject to consent, which is the legal basis of the processing. The User can never be obliged, without alternative, to express his or her consent to receive these cookies, otherwise he or she may not be able to access the site.

Other tracking systems

There may also be other technologies through which the same purposes are pursued as with cookies.

For example, although Cookies can be used in both web and mobile browsers, it would be inappropriate to talk about Cookies in the context of mobile applications, since these are Tracking Tools that require the presence of a browser. For this reason, within this document the term Cookies is only used to specifically refer to that particular type of Tracking Tool. The same criteria used for cookies apply to these technologies

The legal basis for the processing of these cookies is the legitimate interest in the proper functioning of the site. Technical cookies include
